Terms of Service
The rules for using Fapgeist. Read these before you join.
1. Acceptance of Terms
By accessing or using Fapgeist (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Eligibility — 18+ Only
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to access this Service. Fapgeist contains explicit adult content. By using the Service you certify that you meet this age requirement.
3. Account & Access
When you purchase access, you receive personal, non-transferable login credentials. You are responsible for keeping them confidential. Sharing your account or distributing downloads is grounds for immediate termination without refund.
4. Subscription & One-Time Payments
We offer two plans: a monthly subscription ($19/month, recurring) and a lifetime one-time payment ($59). Monthly subscriptions renew automatically until you cancel from your customer panel at the payment processor (Hotmart or Kiwify). Lifetime access is a single payment with no recurrence.
5. Refund Policy
Due to the digital nature of the Service, all sales are final. Refunds are evaluated only in cases of technical failure that prevented access for more than 7 days and that we were unable to resolve. Requests must be made within 7 days of purchase via our contact form.
6. Acceptable Use
You agree not to: (a) redistribute, sell, or share any downloaded content; (b) scrape, mirror, or republish the catalog; (c) reverse-engineer the platform; (d) use the Service for any illegal purpose; (e) attempt to bypass our payment, age verification, or DRM systems.
7. Intellectual Property
All curation, descriptions, design, code, and proprietary content of Fapgeist are owned by us and protected by copyright. Individual games hosted on the platform remain the property of their respective developers. We act as a discovery and access platform, not as the original creator of the games.
8. DMCA & Takedowns
If you are a rights holder and believe content on Fapgeist infringes your copyright, send a DMCA notice via our contact form including: (1) identification of the work, (2) URL of the infringing item, (3) your contact information, (4) a good-faith statement, (5) your physical or electronic signature. We process valid notices within 72 hours.
9. Termination
We may suspend or terminate your access at any time if you violate these Terms, with or without notice. You may stop using the Service at any time. Termination does not entitle you to a refund.
10. Disclaimer
The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability, error-free operation, or the suitability of any specific game for your tastes.
11. Limitation of Liability
To the maximum extent permitted by law, Fapgeist and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Total liability in any matter shall not exceed the amount you paid for access in the 12 months preceding the claim.
12. Changes to These Terms
We may update these Terms periodically. Material changes will be announced on this page. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of Brazil. Any dispute shall be resolved in the courts of São Paulo, SP, Brazil.
